Underage DUI or Worse

To prove underage DUI, the prosecution is only required to show that you had some amount of alcohol in your system. They don't need to prove that you were impaired. They don't even need to have blood or breath test results that show .08 blood alcohol content (BAC).

However, if the state is able to show that your BAC was .08 or greater, they can charge you with standard DUI instead of simply underage DUI. You could face even greater penalties.
