Two Ways to Be Charged With Drunk Driving

In Phoenix and the surrounding parts of Arizona, you can be charged with drunk driving in two situations:

  • Driving With a Blood Alcohol Concentration of .08 Percent or Above: Under this charge, your blood or breath test results show a blood alcohol content (BAC) .08 or above within two hours of driving.
  • Driving While Impaired to the Slightest Degree: Under this charge, the state will have to prove that you were impaired while driving a car. This charge does not require any blood or breath test evidence. It only requires some evidence that you were impaired driving.
